Solutions to Frequently Asked Questions related to HSMP UK Visa

What is the HSMP Points Based Calculator?

Your eligibility for a HSMP will depend on how many points you are able to score in the Points Test. Points are awarded for age, qualifications, work experience, income etc. To enter the UK under the Highly Skilled Migrant Programme (HSMP) you need 75 points.

You can find the HSMP calculator in the link mentioned here

HSMP Points Calculator

What is the Minimum Bank Balance Clause in the HSMP Tier1 application?

At present the waiting time is 14 weeks for Tier 1 HSMP Application. You will need to maintain 2800 GBP balance throughout for 3 months before you Apply. This is in section Z of Tier 1 General Application.

How long is the waiting time to process the HSMP Tier 1 Application?

The UK work permit through the HSMP supposedly takes 6 weeks to process assuming all credentials are accurate.

What is IELTS? Does the new Tier 1 system for UK immigration need IELTS? Is it necessary to complete English language proficiency test for an HSMP UK Visa ?

IELTS is the International English Language Testing System. It measures ability to communicate in English across all four language skills – listening, reading, writing and speaking – for people who intend to study or work where English is the language of communication.

Source: http://www.ielts.org/

As in the old HSMP IELTS, if your degree is attained through 4 years, you don’t require to take up the test. Check below for more details regarding the English Language Points System. But, Even though you have a degree in English you would still need to provide either a letter from your University stating your course was taught in English or have completed an IELTS test showing an overall band score of 6 or above.

Is it possible to work with in UK with a Dependent VISA? Do I need a work permit?

As a Dependant of an HSMP holder you are allowed to work full time in the UK without any restrictions.

I live in India. Is HSMP Scheme the only way to get permission to Enter UK?

Whether you live in India/Elsewhere, If you don’t qualify under the HSMP, you may be able to get a job offer from a UK company and get sponsorship. If not try a working holiday maker visa. Unless you have family connections, I think you need to apply for jobs in the UK before going there. Once you have secured a job, they would able help you apply for a work permit.

If you failed to score enough points on HSMP, you probably needed more experience or a higher salary to qualify. In the short-terms, either get a student visa and enroll for even higher qualifications or marry somebody with higher education and use his or her points in a re-application.

Worst Case, you can visit a consultancy for guidance.

How long can you remain out of uk on Hsmp Visa?

With a HSMP Visa you can stay out of UK for a maximum of 89 days after which your HSMP will not be renewed.

How Do you get a job offer in UK using HSMP?

The HSMP UK Visa scheme does no guarantee you a job. Its just a passport to enter the UK and seek jobs in the same way as any other uk citizen would via agencies or directly from employers.

If you qualify for HSMP, you should have no problem acquiring employment. The qualification process is designed to ensure only people whose skills are in demand are granted entry. The sensible course of action is to obtain your HSMP from your native country and apply for jobs online. Most Reputable IT firms will meet your traveling expenses to attend an interview, and you need not migrate until you have a secure job offer hence avoiding risk.

Firms who offer work under the employers entry visa will sort the whole process out for you once you secure a job offer. Again, all reputable firms will pay your travel expenses to attend interview.

Again, most employers don’t give job offer over the phone, and require you to be holding HSMP permit and also staying in UK.

If you have a hsmp visa that allows you to live and work in the UK. Does that mean you can bring your mom to UK to without having a UK Citizenship.

She would only be able to come over as a visitor usually, staying for a few months at a time. However, if you can show that she is entirely dependent on you to survive (if her husband has passed away), then she could be a “dependent” on your visa, and stay for as long as you wish her to.

Once you have been in HMSP for five years, you can apply for Indefinite Leave to Remain and then for citizenship.

HSMP!! Too Many Complications. Whom Should I have to contact for H1B 2009?

You have to find a company/employer that is willing to sponsor your H1B. Please note that the H1B 2009 cap does not open until April 1, 2009. Once you find a company that wants to sponsor your H1B, you can submit all of the paperwork and they can file the petition for you on April 1, 2009. For the past few years, the USCIS (United States Citizenship and Immigration Service) has been using an electronic random selection process due to the large amount of petitions that they have been receiving. If your case is selected, the USCIS will process your petition. Once your petition is approved, the approval notice will be sent directly to the company that processed your petition. You will have to book an appointment with the consular abroad so that you can get the H1B visa stamped in your passport. Then, you can begin employment of the H1B visa on October 1, 2009.

In what format do I submit the Proof of the 3 Months Minimum Bank Balance along with my HSMP Application?

You can try the following format. Take the Authority Signatory along with the Bank Seal

Dated: dd.mm.yyyy

To Whomsoever It May Concern

This is to certify the Mr. XXX is maintaining a Saving account no XXXXXXXXXX with us since DD.MM.YYYY.
The account balance as on DD.MM.YYYY is INR XXXX.
The balance maintained during the period DD.MM.YYYY to DD.MM.YYYY for account no XXXXXXXXXX is INR YYYY.

The certificate is issued at the specific request of the account holder and holds no responsibility on the official signing on it.

DO we need to maintain minimum 800£ constantly for 3 months before applying HSMP.

Last month 1 day i haven’t maintain minimum 800£ balance in my bank.
    Is it become any problem.

  2. nuklear Says: October 8th, 2008 at 6:57 pm

@Vijay: If you are applying to a British overseas entry clearance post for permission to go to UK (known as ‘entry clearance’), you must have £2,800 in available funds for the whole of 3 months. Even a day of Non-Availability out of 3 months (even if last day) is considered NOT Acceptable.

I Was at UK under HSMP visa between Jan 2006 to Jan 2007. During this period a new guideline (Point system) of HSMP came in to the force. In this criteria I was not qualified and that’s why I did not applied for extension and left UK before expiry of my visa.

Now please inform me weather I can be qualified for HSMP visa as per present rules.

Your guidance in this regard will be highly appreciated.

Information on your blog is very useful. I was searching for clear info like this for hours. Thanks for putting it up.
Now I have one question. This is based on Vijay’s question above and your response to that, EC application – is it different from the HSMP application? Is it possible for one person to apply for HSMP and not to go on his own to UK, but find a job thru online job sites, in that case will it be required to maintain the bank balance prior to applying for the HSMP? My question might look like dumb, but I am seeking your help on this.
    Thanks.

  6. nuklear Says: October 14th, 2008 at 4:59 am

@Sam: HSMP is just like a passport to go to UK. I mean that takes care of only your Entry level to the UK. Finding a Job is all left to you. It does not come as a package with your HSMP. You could find a job via Online Job Sites/Through Consultants etc.

You need to maintain Minimum Balance to be eligible to Apply for an HSMP. This has nothing to do with finding jobs.

Can you clarify the following question for me, I was under the impression that if you are on HSMP, you can be out of the UK for up to 15 months in a 5 year period, but your FAQ says 89 days.

Can you please confirm which is correct?

    Thanks,

    Hi,

Thanks for providing this helpful information. I am currently 28 and thinking about working in the UK. I know I cannot go there to start work until I am 29, however the points calculator rewards you for being 28 or under. So my question is:

Suppose I apply now and am granted the Visa. Can I wait a year before using it? What is the maximum time I can wait to use the Visa before it becomes invalid?

    Thanks.

    Thanks in advance.

Points for maintenance (funds): Can I consider my bank fixed deposits to get points under this clause.

    > The Fixed Deposits are in my name and drawn from my savings bank account under the same Customer ID.

  18. saptek Says: November 20th, 2008 at 2:14 pm

Fund maintenance: Is it mandatory that the fund is maintained in the salary account only and that any other account would be considered invalid.
In my case I have a salary account with one bank, an NRI account with another bank and a current account in UK as well. My salary account does not have the required fund balances but the other accounts do. So would those accounts be considered in the Fund maintenance criteria.

    Thanks in advance.

I showed my salary account in which I had funds in excess but the saving went down below £800 for 3 days in the 3 month periods. So, I compensated this by attaching the bank statement of my other account for the same period. Can you please confirm if this is acceptable

I have a peculiar problem. I want to apply for Tier 1. I have enough funds to show in a Bank and enough points to qualify.

I have one child and at the current time my wife is due to deliver in Jan end.

In the application, I was asked to mention people who are dependant on me. I plan to go first and then take my family by april. How to go about this odd situation?

    Any advice appreciated.

    Thanks,
    Ravi

I sent my appliation on the 1st Dec, how long this will take to process? As am currently in a full-time employment, only allowed to work for one month after my visa expired. My previous visa expired on the 13th Dec 2008, in this case, I am only allowed to work till 13th Jan 2009. Is there anyway to chase HomeOffice speed up my application?

Otherwise, you think I will get the visa back by the 13th Jan 2009 if all information provided correct?
Or I can fax/send a letter from my current employer to Honeoffice to clarify my current situation, does this help?
    Many thanks.

    C) What are the fund maintainence requirements for my husband as spouse applicant ? (Min daily amount needed and period)

    Hi

I have decided that the information on the goverment websites for this subject are complete jargon lol. Can anyone please help to clarify what the official name is for the Tier one as it gets changed a lot? Also:
    1) When the Tier 1 general is applied for from outside the UK eg for an Indian or Malaysian national do you have to obtain an LTR (Leave to Remain visa) or entry visa/entry clearance at the UK embassy in home country or does the approval of the Tier 1 give you automatic entrance into the UK?

Is the LTR valid for the same length of time as the Tier 1?

    2) What sort of documentation do you get once the Tier 1 is approved?

    3) Is the initial Tier 1 application valid for 3 years, then you can apply for a 2 year extension and after this you can apply for permanent residency?

Sorry i am just very confused and hope you can help.

    Many thanks

    Ange

    Hi,

My name is Satya and I have received the UK Entry Clearance.

I need some clarity on the validity of this visa.

I keep hearing that, I should pay a visit to the UK within 6 months from the date of issuance of my visa?
In my case, it is in October 2008 that I have received the visa. Does that call for a UK visit before March 2009?

Please advise, so that I can plan my itinerary accordingly.

Do revert if you need more details.

    Hi All,

Could some one please answer this question.

My Question is going forward After 5 year can i apply for Permanent Residence(PR) claiming the stay from June 2007.

I came on a Work Permit in June 2007 to UK. My Project ended in the month of April 2008 and i am forced to go back to India, after 1 month again i came to UK on a Business Visa and stayed for 2 months and went back to India, and stayed India for more month and in the month of September 2008 i again entered into UK on a new Work Permit.

This time I got 5 years work permit from UK based company.

Starting from June 2007 till Date it’s 18 months of Stay in UK out of that 2 months stayed in India and 2 months stay in UK on Business Visa.

As per Prerequisite applying UK PR, one should not be out of UK for more than 90 days, and in above case it’s not happening.

Earnings for 12 months from the last 15 mths prior to the date of application, employment will only be considered. Points for earnings in AED (Band A) can be found on ukvisas website, however from UAE you need to have GBP 40000/- equivalent earnings over 12 months. Calculation of salary can be found out from electronic assessment points based calculator available on ukvisas website. Totally you need to score 75 (from 4 attributes) + 20 ( compulsory for english language and maintenance)

Q.2 Until october 2008 if you apply for TIER 1 visa, you only need to send one bank statment with the closing balance of 800 pounds. so in the beginning of the month i dont have the 800 pounds but after 10 days later when my parents send me the money i have the balance 1700 pounds till the end of the month. so is it ok or this will cause any problem to get the visa.

    Hi Mikie,

800 Pound a month is very very low. You will barely be able to survive in this. Plz check is it 800 per month or 800 per week.

You need a minimum of GBP 1300 to sustain in the UK and a bit higher in London in particular.

    Approx Expenses
    Housing – Rent + Utility bills £800.00
    House Expenses + Groceries £300.00
    Commuting £250.00
    Telecom + Internet + TV £50.00

Subject : Please advice me about the documentary evidence which I mention underneath is enough or any other for of documents are required if so please guide me for appling for Tier 1.

Sir /Madam ,This is Kashyap writing to you from Hyderabad ,regarding doubts about the documentary evidence that should be provided for assessment of Tier -1 visa , I have been working in a Government Lab as Lab Research Technician and my monthly pay is 7900 and I also work on online data entry job which pays me 19,000 ,but both the payments mentioned are in cash and the amount that I get from data entry is taxable ,they pay cash because there are very few people so managing accounts is not a problem. But 7900 is not taxable .which totally amounts to 26,900 and which comes to 3,22,800 /year which I qualify according to todays pound rate ,but my question is can I produce the payslips for both the earnings and tax return for the taxable amount because I don’t have any regular bank statement to prove my earnings, if this is not enough please let me know what other evidence should be submitted ,awaiting your suggestion at the earliest to proceed further in this regard

    Thanking You yours faithfully

    Hi All,

I got my HMSP approval letter in Jan 08 and filed EC from Malaysia in April 08. Since May 08 till date (Mar 09) I am in UK on 2 yr HSMP visa. In this meanwhile in 2008 HSMP was replaced by Tier-1, which is a 3 yr visa. Now, UK Govt is changing rules in Apr 09 to include Masters degree and £20k as critirea for new UK entrees. Do these new rules apply to me as well being in UK? I want to complete my 5 yrs before planning to moving out.

    1. Do I need to change into Tier-1 now or should I wait and until when
should I wait? If I do it during my 2 yr HSMP visa still running,
will it add 1 more yr to my 2 yr visa to make equivalent to 3 yr
Tier-1 visa? Should I do it before April 09 rules come in or after
(if it does not effect me)?
    2. Should I change the status to Tier-1 or should I renew into Tier-1
at the time of renewal after my current 2 yr HSMP expires, when the
new rules of Apr 09 also come into effect (will they effect me while
    I’m in UK)?

i applied for the tier 1 (post- study work) and was refused initially as a result of lack of maintainance , i then re-applied by the premium service at the public enquiry office but a decision was not made on my application on that day and was told it will be sent in a weeks time.up until now am still waiting for a reply from home office. in under to make up the £800 funds i used a foreign statement could this be the reason why my papers has not arrived.

    Hi,

I am currently holding a valid UK General Migrant tier 1 visa. I would like to know if there is a stipulated time within which I have to make the first entry to UK from the visa validity start date.

Is it acceptable to enter UK say after, 10 months from the validity start date? If not, does this have a repercussion on visa extension at the end of 3 years or otherwise on filing a PR?

    Your advise would be appreciated.

    Thanks!

I have Tier 1 Visa and am planning to go to UK for a quick visit, mostly to tour and get a feel for the place. I have a couple of questions:
    1) Will I be allowed to enter UK as a short term visitor, if I mention that my intent is to just tour for a short visit?
    2) What documents (apart from Passport with stamped Visa) should I carry with me?
    3) I will be entering via Train. Any major thing I should keep in mind?

Any help will be very appreciated. If you can point me to any resource that talks about these things, it will also be helpful.
    Cheers.

With a HSMP Visa you can stay out of UK for a maximum of 89 days after which your HSMP will not be renewed.

Is this true for Tier 1 General?
Anywhere on the Home office website where this is published?

    Hi
I applied for the Tier 1 UK visa in march 2009. I have heard they can post date a preferred start time on the visa by 3 months.

Is there a time period by which I must enter the UK after I have been given the Tier 1 visa? or does the time just start ticking over from June (3 months after I lodged the application in March)?

Roughly how long does it take for them to process the Tier 1 visa applications? I sent it away mid-March 2009.

    Hi,
I am on HSMP visa and currently working in UK. My HSMP Visa will expire next year and for that I will have to make an application for extension before the expiry. Now, one of the confusing requirements is days spent in UK. Say, if I was working for a company that is in international consultancy then I would be required to make frequent international trips to meet clients etc. Would that periodic short term travel say 1 week or 2 weeks at a stretch would reduce my quota for total ex-UK leave permissible? Secondly, are days spent outside UK will be looked at when I would apply for indefinite leave after 5 years or also at the time of extension after spending initial 2 years in UK?
    Thanks

  83. www.tier1visashop.com Says: May 6th, 2009 at 11:40 pm

    @luxmy
If it is taking so long, you can rest assured that your application will not be rejected. If it had to be rejected, they would have done it in a short span of time – like how they did it previously. It might just be the fact that the Home Office might be under pressure with loads of applications or maybe that the verification of your documents is taking time.

  84. www.tier1visashop.com Says: May 6th, 2009 at 11:43 pm

    @Fayyaz
If you are applying only for extension and not for ILR, you need not be bothered at the moment regarding your time spent outside UK. Time spent outside UK, will be taken into consideration only when you are applying for ILR. Even then, it will be given a long duration – almost 9 months – that you can stay outside UK in the preceeding 5 years.

  85. Lisa Says: May 7th, 2009 at 3:32 pm

Luxmy, I’m in the same boat – my application dates to early March and I cannot get ANY info on when it will be issued or if there is a problem.

I’ve been offered work that requires travel (ironically it’s for Cross-cultural awareness training!), and have been asking my prospective employer and his clients to wait-wait-wait as I prepare for this job on a volunteer basis… I still have a US business and could work as a contractor for one or two projects, but I can’t leave the UK without forfeiting my workpermit application, so I’m stuck.

If you have any advice or ideas on worst-case processing time, I’d appreciate it. This job is very much in jeopardy now, as is the relationship with the client. I imagine the UKBA staff must be trained to say “we can’t help” and cut off the conversation, but it’s incredibly frustrating.

  86. luxmy Says: May 17th, 2009 at 10:49 am

    Hi Lisa
If your training progamme is urgent you could ask that company to send you an email or a letter and you could fax or hand it over to the UK embassy in your country so that they will process your application fast.this is what I was told when I called the embassy. The web site also says that there is a backlog of application which were submitted in March.

I sent an administrative review in February and Ive not heard anything about it so far. Also since my HSMP was expiring in March i reapplied and in the new application cover letter Ive mentioned about the Administrative Review.I have attached two new docs with the second application.
1.Will I get a reply for the review what sent in February?Or will they cancel the review because Ive applied again?
2 The web site says that the review will be sent to another place not the place where it was refused so will i get a reply and how long will it take?
3.I applied under Tier 1 Transitional.Do they call the present employer and check whether I am still working there?

I have plans to stay in UK for a minimum of 5 years and would file for a PR if possible in furture. But being out of UK currently, might be even more than 89 days, would it cause any issues ??

  105. Jignesh Says: August 28th, 2009 at 8:36 am

    @Riya

Its not mandatory for you to enter UK within some timeframe. However while applying for extension you are required to show 12 months earning period in UK from last 15 months of your visa.

Obviously it will affect your PR application. You are requierd to stay in UK to make a PR application. You have to stay in UK and you can not remain outside UK for longer duration.

You can get extension on your visa even after 5 yrs.

    Cheers

    Hi all,

A desparate call for help! A friend of mine is applying for an HSMP Visa extension.

The situation is that, he has maintained sufficient funds through out his previous months, although today he’s ended up with funds under £800.00.

I’ve read all threads regarding insufficient funds (not very impressive), but is he going to be on the safe side if he replenishes his account by EOB today???

    HELPPPPPPP PLEASEEEEE!

I really like your template, its simple but easy on the eyes and easy to navigate was it a paid or free template?

This place is not very helpful i have to say. Anyway regarding my post above, all is ok, if your balance goes just below the required amount of £800.00, and you plan to replenish your account on the same day before EOB, and it’s only a one off. You most probably will get away with it. Pheww!

    Hi all,

I am currently on Tier 1 General visa and have been staying in the UK for the last 3 years. I want my wife to join me in the UK.

She applied for her Tier1 general dependent visa in Sept09 from India and British High Commission rejected because of low maintainence funds. It was surprising as I sponsored her and gave 3 different bank/building society statements for the last 6 months with good enough balance. It seems that the Visa officer made a mistake and only looked at 1 statement and that too the one with lowest balance.

There was no provision of making an appeal. My wife then applied for tourist visa so that she could visit me for few months, go back to India and re-apply for dependent visa. Now, this time her tourist visa also got rejected as Visa officer is not satisfied that she intends to go back to India before expiry of tourist visa. This time she is given an appeal form along with the rejection letter.

I am not sure what is the best option for me at this stage. Since her visa has been rejected twice in the last one month, I am really cautious this time. Should I make an appeal or apply fresh for dependent visa or is there any other option?

    Could anybody please advice?

    Many thanks,
